These Terms and Conditions of Service govern the use of the website www.sardiniaparadisetour.it (hereinafter, the "Site") and describe the nature of the services offered by Simone Malavasi, with registered office in Via Lu Fraili snc 07052 San Teodoro (SS), VAT number 01648900916 (hereinafter referred to as "SPT").

By browsing the Site and using the booking forms or widgets present, the user accepts in full and without reservation the conditions set out below.

1. NATURE OF THE SERVICE AND ROLE OF SPT

Sardinia Paradise Tour (SPT) operates exclusively as a digital intermediary, advertising channel, and business agent.

SPT is not a tour operator or travel agency; therefore, it does not organize, directly sell, or provide any type of excursion, tour, or tourist service.

The Site has a purely informational and promotional function ("Showcase") and hosts technological systems and booking widgets owned exclusively by Shardan Tour, a Tourist Services Agency (operating with regular ATECO macroclass code 79.90 and related subcategories).

2. CONTRACT COMPLETION AND PAYMENT MANAGEMENT

The user acknowledges and accepts that:

  • Any reservation or purchase of excursions made through the widgets on the Site constitutes a direct and exclusive transaction contract between the end user and Shardan Tour.
  • The financial flows and payments entered by the user are processed, collected and managed directly by the host and Shardan Tour's payment systems. No sums of money pass through or are retained by SPT.
  • The issuance of tickets, booking vouchers, receipts, or invoices is the exclusive responsibility of Shardan Tour, the sole entity holding the commercial relationship with the customer.

3. MANDATORY REFERENCE TO THE TERMS AND CONDITIONS OF SHARDAN TOUR

Since these services are entirely provided and contracted by third parties, the user is required to read, understand, and accept the contractual, operational, and transportation conditions of the actual operator before completing any booking.

All the necessary information relating to:

  • Prices, rates and operational details of the excursions;
  • Cancellation policies, booking modifications and refund requests;
  • Transport regulations, conduct on board and baggage liability;
  • Management of weather and sea conditions and postponements;

4. LIMITATION OF LIABILITY AND INDEMNIFICATION

Since the contracts with the vehicle suppliers, on-board staff, tourist guides and the related mandatory insurance coverage are the exclusive responsibility of Shardan Tour, Sardinia Paradise Tour (SPT) is fully indemnified and free from any civil, criminal or administrative liability regarding:

  • Technical malfunctions of the booking widget that prevent or duplicate a purchase;
  • Schedule changes, itinerary changes, delays, suspensions or cancellations of promoted excursions;
  • Accidents, accidents, losses, thefts or damages to things or people that occur before, during or after the performance of the tourist service;
  • Failure, partial or incorrect performance of the service by Shardan Tour or its subcontractors.

Any complaints, disputes, requests for compensation or refunds must be addressed directly and exclusively to Shardan Tour customer service.

5. PROCESSING OF PERSONAL DATA (PRIVACY)

The personal and sensitive data (including credit card details) entered by the user in the booking widget are collected and processed directly by Shardan Tour as the Data Controller for the purpose of performing the requested service. SPT does not access, store, or process the financial or personal data entered in the widget. 6. APPLICABLE LAW AND JURISDICTION

These Terms and Conditions are governed by Italian law. Any dispute arising between you and SPT regarding the use of the Site or the interpretation of these terms and conditions will be subject to the exclusive jurisdiction of the Court of Tempio Pausania.
